Terms of Service

These terms govern your use of Arbor, a performance-review evidence tool operated by an independent developer based in India (“Arbor”, “we”, “us”). By creating an account or connecting an integration, you agree to these terms on behalf of yourself and the organization you represent.

Arbor is currently in early beta. Functionality, pricing, and these terms may change as the product matures. Material changes will be announced in-product and by email to tenant administrators at least 14 days before they take effect.

1. The service

Arbor reads activity data from systems you connect (today, GitHub and Jira) and uses it together with rubrics you provide to generate evidence packets that managers and calibration committees use as input to performance reviews. Arbor does not produce final ratings, compensation decisions, or employment decisions; it produces evidence and narratives that humans interpret.

2. Accounts and access

  • You are responsible for keeping your credentials secure and for all activity under your account.
  • Tenant administrators are responsible for who they invite into their tenant and for ensuring those invitees are entitled to view the connected activity data.
  • You must have authority from your organization to connect a GitHub org, a Jira site, or any other system to Arbor.
  • You must promptly notify us at madhavsainanee123@gmail.com if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Use Arbor to harass, surveil, or retaliate against employees.
  • Connect systems you are not authorized to read.
  • Reverse-engineer, scrape, or attempt to bypass the service's security controls.
  • Upload personal data of minors, sensitive special-category data (health, biometric, etc.), or any data not necessary for performance review.
  • Use Arbor in violation of any applicable law, including data protection and employment law in your jurisdiction.

4. Your data

You retain ownership of the data you upload and the data Arbor ingests on your behalf. By using the service you grant Arbor a limited license to process that data solely to deliver the service. How that data is handled is described in the Privacy Policy, which is incorporated into these terms.

5. Third-party services

Arbor relies on third parties — GitHub, Atlassian, and an LLM provider you choose — to deliver the service. Your use of those systems is also governed by their own terms. Arbor is not responsible for outages, rate limits, or changes in those systems.

6. Beta service, no warranty

Arbor is provided as is and as available during the beta. We do not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose. We do not provide a service-level agreement (SLA) during the beta. Outputs of the LLM-generated narratives may contain inaccuracies and must be reviewed by a human before being used in any consequential decision.

7. Limitation of liability

To the fullest extent permitted by law, Arbor and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the fees you paid Arbor in the twelve months before the claim arose, or (b) one hundred United States dollars (USD 100).

8. Indemnity

You agree to indemnify and hold Arbor harmless from any claim by a third party arising out of (a) your violation of these terms, (b) your unauthorized connection of a system you did not have rights to read, or (c) your misuse of review evidence produced by the service.

9. Termination

  • You can stop using the service and delete your account at any time from the dashboard.
  • We may suspend or terminate accounts that violate these terms, create undue load on the service, or appear to compromise the security of other tenants.
  • On termination, your data is deleted in line with the retention schedule described in the Privacy Policy.

10. Governing law

These terms are governed by the laws of India. Disputes will be resolved in the courts of Bengaluru, India, unless otherwise required by mandatory consumer-protection law in your country of residence.

11. Changes

We may update these terms. Material changes will be announced in-product and via email to tenant administrators at least 14 days before they take effect.
